New York State Education Law 2-D
In order to conduct a successful education program for your student(s), the Plainview-Old Bethpage CSD receives, creates, stores and transfers information about students, teachers and principals that is protected by state and federal law. The District takes active steps to protect the confidentiality of protected information in compliance with all applicable state and federal laws. The District expects all District officers, employees and partners to maintain the confidentiality of protected information in accordance with state and federal law and all applicable Board Policies.
New York State Education Law 2-d went into full effect on January 13, 2020 . The law focused on the privacy and security of personally identifiable information (PII) of students, classroom teachers, and principals. Education Law 2-D protects any information that can be used to identify an individual either directly or indirectly when linked with other information within New York's educational agencies and/or any outside parties they may interact with, as well as pertaining to the unauthorized release of any type of personally identifiable information.

Additional Information from New York State Education Department (NYSED)
The Board of Regents adopted Part 121 of the Regulations of the Commissioner of Education on January 13, 2020. These rules will implement Education Law Section 2-d and provide guidance to educational agencies and their third-party contractors on ways to strengthen data privacy and security to protect student data and annual professional performance review data. The regulation went through multiple sets of revisions and three rounds of public comments and will go into effect January 29, 2020. It will apply to both charter and traditional public schools. We thank the members of the Data Privacy Advisory Council for the implementation of planning and drafting workgroups that supported the Department’s Chief Privacy Officer, Temitope Akinyemi, through this process.
