At Plainview-Old Bethpage Central School District (POB), we take the privacy and security of Personally Identifiable Information (PII) seriously. We are committed to protecting the data entrusted to us by students, families, and staff in compliance with state and federal laws, including New York State Education Law § 2-d.
To ensure data remains safe, we implement strict security measures and only share information when absolutely necessary. We work closely with trusted vendors who meet high standards for data protection.
POB, along with the New York State Education Department, is committed to promoting sound information practices and policies that strengthen data privacy and security within the educational community, while also empowering parents with information and supporting efficient and effective school operations.

What is NYS Ed-Law 2-D
In order to conduct a successful education program for your student(s), the Plainview-Old Bethpage CSD receives, creates, stores and transfers information about students, teachers and principals that is protected by state and federal law. The District takes active steps to protect the confidentiality of protected information in compliance with all applicable state and federal laws. The District expects all District officers, employees and partners to maintain the confidentiality of protected information in accordance with state and federal law and all applicable Board Policies.
New York State Education Law § 2-d went into full effect on January 13, 2020 . The law focused on the privacy and security of Personally Identifiable Information (PII) of students, classroom teachers, and principals. New York State Education Law § 2-d protects any information that can be used to identify an individual either directly or indirectly when linked with other information within New York's educational agencies and/or any outside parties they may interact with, as well as pertaining to the unauthorized release of any type of personally identifiable information.

Additional Information from New York State Education Department (NYSED)
The Board of Regents adopted Part 121 of the Regulations of the Commissioner of Education on January 13, 2020. These rules will implement New York State Education Law § 2-d and provide guidance to educational agencies and their third-party contractors on ways to strengthen data privacy and security to protect student data and annual professional performance review data. The regulation went through multiple sets of revisions and three rounds of public comments and will go into effect January 29, 2020. It will apply to both charter and traditional public schools. We thank the members of the Data Privacy Advisory Council for the implementation of planning and drafting workgroups that supported the Department’s Chief Privacy Officer, Temitope Akinyemi, through this process.

Federal Laws to Protect Students
Family Educational Rights and Privacy Act (FERPA)
The foundational federal law on the privacy of students’ educational records, FERPA safeguards student privacy by limiting who may access student records, specifying for what purpose they may access those records, and detailing what rules they have to follow when accessing the data.

Protection of Pupil Rights Amendment (PPRA)
PPRA defines the rules states and school districts must follow when administering tools like surveys, analysis, and evaluations funded by the US Department of Education to students. It requires parental approval to administer many such tools and ensures that school districts have policies in place regarding how the data collected through these tools can be used.
Children's Online Privacy Protection Rule (COPPA)
COPPA imposes certain requirements on operators of websites, games, mobile apps or online services directed to children under 13 years of age, and on operators of other websites or online services that have actual knowledge that they are collecting personal information online from a child under 13 years of age.

8625 – Privacy and Security For Student, Teacher and Principal Data
The Board of Education recognizes its responsibility to enact policies that provide privacy for student, teacher and principal data in accordance with law. This is particularly relevant in the context of the administration of student data which is collected, surveys that collect personal information, the disclosure of personal information for marketing purposes and in conducting physical exams. Board Policy 8635-R.

Inventory
Software (programs/web-based applications) used in the District, both free and subscription-based, are vetted for compliance with New York State Education Law-2d. The software inventory link below will be updated throughout the year. In addition, where appropriate, we have included supplemental information that further explains the protection of student and staff data.
The Plainview-Old Bethpage CSD maintains an inventory of all software and services utilized within the district that collect, store or process student information. In order to make this information as easily accessible as possible to our community and comply with requirements outlined in law and regulation, we have posted our inventory and supplemental information related to the contracts for those products and services on our website. We will update the inventory periodically to reflect any changes in product or service usage.
